These Terms of Service govern any project undertaken with Mustard Seed Digital Studio ("we," "us," or "our"). By submitting a project inquiry or engaging us for work, you agree to the terms below.
Services
We provide custom web design and development services. The specific scope, deliverables, and requirements for each project are defined individually — through the project inquiry form and any follow-up conversation — before work begins, not by these general terms.
Fees & Payment
Projects are billed hourly at a rate agreed upon before work begins. There is no fixed package pricing. Invoices are issued periodically as work progresses and are due within 15 days of receipt unless otherwise agreed in writing.
Project Timelines
Any timeline discussed is an estimate, not a guarantee. Timelines depend on project scope and on receiving timely feedback, content, and approvals from you — delays on your end will shift the delivery date accordingly.
Revisions
Reasonable revisions within the agreed project scope are included. Requests that expand beyond that original scope are treated as additional work and billed at the same hourly rate.
Client Responsibilities
You're responsible for providing the content, assets, feedback, and approvals needed to keep a project moving. Work may pause, and timelines may shift, if these aren't provided in a timely manner.
Intellectual Property
Ownership of final project deliverables transfers to you upon receipt of full payment. Until payment is complete, all work product remains the property of Mustard Seed Digital Studio. We retain the right to showcase completed projects in our own portfolio unless otherwise agreed.
Third-Party Costs
Costs for hosting, domain registration, premium plugins, stock assets, or other third-party services are separate from our design/development fees, unless explicitly included in a project agreement.
Cancellation
Either party may end an engagement with written notice (email is sufficient). You're responsible for payment of all hours worked up to the cancellation date.
Limitation of Liability
We aren't liable for indirect, incidental, or consequential damages arising from the use of a completed website. Unless a separate maintenance agreement is in place, we don't guarantee uptime or ongoing performance after a project is delivered.
Governing Law
These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law principles.
Changes to These Terms
We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision.
